If you play in a standard scoring 10-team league, there's no good reason to reach that early for a TE. Sure, it's nice to have a decent scoring threat at TE, but the potential value of a breakout player picked from No. 40 to 60 is simply too great.
Here are some 2009 examples of guys you could've had from pick 40 to 60, according to 2009 ADP lists: WR Vincent Jackson, WR Chad OchoCinco, WR DeSean Jackson, RB Joseph Addai, WR Brandon Marshall, RB Thomas Jones, RB Jonathan Stewart.
